Alberta Minor Injury Regulation (MIR) came into force on October 1, 2004. The purpose of this regulation is to limit maximum amount recoverable for minor injuries occurred in an Alberta motor vehicle accident. In Alberta Minor Injury Regulation (MIR), minor injury means sprain, strain, or WAD injury that does not result in a serious impairment.
Every year the Superintendent of Insurance announces maximum amount recoverable for minor injuries occurred in an Alberta motor vehicle accident which is also referred to as minor injury cap. The new maximum amount recoverable for minor injuries occurred in Alberta motor vehicle accident on or after January 1, 2020 is $5,296.
Most of personal injury claimants and bodily injury claims adjustors always misinterpret and misunderstand Minor Injury Regulation (MIR) due to its complex and confusing language and wrongfully conclude those injuries as minor injuries which are not minor at all.
