Canadian Refugee Claims
The Refugee Protection Division (RPD) of the Immigration and Refugee Board of Canada (IRB) decides all eligible refugee claims which were either made at any port of entry to Canada or at an Immigration, Refugees and Citizenship Canada (IRCC) office.
You can make a claim for refugee protection at any port of entry to Canada or at certain Immigration, Refugees and Citizenship Canada (IRCC) offices in Canada. If your claim for refugee protection is found eligible, it will be referred to the Refugee Protection Division (RPD) of the Immigration and Refugee Board of Canada (IRB).
Refugee Protection Division (RPD) will schedule a hearing for your claim for refugee protection to determine whether you are a Convention refugee, or a person in need of protection. In addition to you and your counsel, if you have any, the Minister’s Counsel will also be attending the hearing if the Minister has intervened.
If your claim for refugee protection is accepted, you will get “protected person” status unless the Immigration, Refugees and Citizenship Canada (IRCC) or the Canada Border Services Agency (CBSA) appeals the Refugee Protection Division (RPD) decision to the Refugee Appeal Division (RAD) or apply to the Federal Court of Canada for application of leave and for judicial review of the Refugee Protection Division (RPD) decision within 15 days of receiving your Notice of Decision and reasons for decision.
If your claim for refugee protection is rejected, you can appeal to the Refugee Appeal Division (RAD) within 15 days of receiving your Notice of Decision and reasons for decision or If you are not eligible to appeal to the Refugee Appeal Division (RAD), you can file application for leave and for judicial review to the Federal Court of Canada.
