Federal Judicial Review Applications
APPLICATION FOR LEAVE AND FOR JUDICIAL REVIEW OF IMMIGRATION AND REFUGEE PROTECTION MATTERS
If you have received a negative decision on immigration and refugee protection matters, you can apply for judicial review of the immigration and refugee protection matters to the Federal Court of Canada. To apply for the judicial review of a matter that falls under the Immigration and Refugee Protection Act (IRPA), you must first obtain leave from a judge of the Federal Court of Canada.
There are certain timelines to file and serve an application for leave and for judicial review. If the matter of judicial review arose in Canada, you must serve the application for leave and for judicial review on the other party and file the same with the Federal Court registry within 15 days after the day on which you are notified of or become aware of the matter to be reviewed. If the matter of judicial review arose outside Canada, you must serve the application for leave and for judicial review on the other party and file the same with the Federal Court registry within 60 days after the day on which you are notified of or become aware of the matter to be reviewed.
APPLICATION FOR LEAVE AND FOR JUDICIAL REVIEW OF CITIZENSHIP MATTERS
If you have received a negative decision on citizenship matters, you can apply for judicial review of the citizenship matter to the Federal Court of Canada. To apply for the judicial review of a matter that falls under the Citizenship Act (IRPA), you must first obtain leave from a judge of the Federal Court of Canada.
You must file an application for leave and for judicial review with the Federal Court registry and serve the same on the other party within 30 days after the day on which you are notified of or become aware of the matter to be reviewed.
