Wills, Personal Directives and Enduring Power of Attorney
A Will is a legal document which states how you want your estate to be distributed after your death. You should consult a lawyer to ensure that your Will is valid as per the Wills and Succession Act of Alberta and other applicable laws to have your testamentary wishes fulfilled.
You should also consider preparing your Personal Directives and Enduring Power of Attorney with your Will. You can plan in your Personal Directives that who will make personal decisions on your behalf if you lose your mental capacity to make personal decisions due to your illness or injury, whereas; Enduring Power of Attorney can be prepared to plan that who will deal with your financial affairs if you become mentally incapable of making your financial decisions.
General and Specific Power of Attorney
A Power of Attorney is a written document in which you can appoint an attorney to act on your behalf to handle your general or specific matters.
You can set out in your Specific Power of Attorney that what specific matters your appointed attorney is authorized to decide on your behalf, whereas a General Power of Attorney can be prepared to authorise your appointed attorney to decide any matter that you are legally capable do.
To appoint someone as your attorney in your power of attorney, you must ensure that the person you are appointing is reliable, trustworthy and mature enough to deal with authorized matters on your behalf.
